The type of personal information we collect

We currently collect and process the following information:

  • Personal identifiers, contacts and characteristics (for example, name and contact details)

  • Candidates: We collect and use only the information necessary to help us find suitable opportunities and any further information needed to assess your eligibility through the different stages of the recruitment process. This information includes CVs, identification documents, educational records, work history, employment and reference information.

  • On occasion, we may also collect sensitive personal data about you, related to your health, diversity information or details of any criminal convictions. We only collect sensitive personal data from you, and further process this data, where you have given your explicit consent in advance. This information is to support your application with a client who is potentially interested in your application. 

  • Clients: We collect and use only the information necessary to provide you, or people in your organisation with services such as finding the best available candidates for your opportunities. This is for active and prospective clients. This extends to business contact details such as email and phone number.

  • Website Users: We collect and use only the information necessary to improve your experience when using our website. This may include how, when and how often you visit us.
     

How we get the personal information and why we have it

Most of the personal information we process is provided to us directly by you for one of the following reasons:

  • To help clients with the recruitment of their vacancies by matching candidates against their requirements. This is done mainly by the information documented on CVs and we get these from publicly available websites such as LinkedIn and Job Boards, where candidates have uploaded their CVs to find a new position. We also get the information from recommendations from friends, former or present employers or colleagues/ex colleagues.

  • Directly from you. This is information you provide while searching for a new opportunity and/or during the different recruitment stages, or during our work with you to ensure that our relationship runs efficiently.

  • Through publicly available sources. For example;

    • LinkedIn

    • Job Boards

    • By Reference or word of mouth. For example, you may be recommended by a friend, a former employer, a former colleague or even a present employer.

  • We use the information that you have shared with us in order to share the above information with our clients in order to match your skills and experience with their open vacancy.
     

We may share this information with clients we are working with in order to fill open positions they have available.

Under the UK General Data Protection Regulation (UK GDPR), the lawful bases we rely on for processing this information are:

(a) Your consent. You can remove your consent at any time. You can do this by contacting info@jenkinsrecruitment.com.

(b) We have a legitimate interest.

What legal basis do we have for using your information?

For prospective candidates, contractors, referees and clients, our processing is necessary for our legitimate interests - we need this information in order to be able to assess suitability for potential roles, to find potential candidates and to contact clients and referees, and suppliers.

If you are interviewed and submitted as a candidate, then this may involve the processing of more detailed personal data including sensitive data such as health information that you or others provide about you. In that case we always ask for your consent before undertaking such processing.

Where we need consent for some activities such as contacting candidates about other recruitment-related services we will ask for it. We rely on soft opt-in consent for these activities where you have previously engaged with us by submitting a CV, applying for a job, or registering on our website. This means we take your consent as given unless or until you opt-out. For other types of e-marketing we require your explicit consent.

How we store your personal information

Your information is securely stored. We take the security of your data very seriously and have put in place appropriate measures that are designed to prevent unauthorised access to or misuse of your personal data. Records of applications from hirers and work-seekers must be kept for at least 1 year from when the agency or business last provided its services for them.

General Data Protection Regulation (GDPR) plays a significant part in recruitment when it comes to collecting, handling and sharing candidate data. With respect to candidate and client information that is stored in the JobAdder system.

​

We use Job Adder as our database to store all our client and candidate data.  JobAdder has a Multi-Factor Authentication (MFA) feature, which requires two proofs of identity (JobAdder password and authenticator app code on the user’s mobile) to grant access to your JobAdder account.  A link to their privacy policy can be found here.

Jenkins Recruitment Solutions are the data controller and hold the direct relationship with our clients and candidates. We retain ownership of the client and candidate records that we store within our JobAdder account.

JobAdder, as the data processor, acts on our instructions when processing the candidate and client information stored in your JobAdder account.

​

We will only retain your CV and personal data on our files for as long as is necessary for us to use your information as described above or to comply with our legal obligations. However, we may retain some of your information after you cease to use our services, if we believe in good faith that it is necessary to meet our legal obligations, such as retaining the information for tax and accounting purposes.

When determining the relevant retention periods, we will consider factors including:

(a) our contractual obligations and rights in relation to the information involved;

(b) legal obligation(s) under applicable law to retain data for a certain period of time;

(c) statute of limitations under applicable law(s);

(d) (potential) disputes;

(e) if you have made a request to have your information deleted; and

(f) guidelines issued by relevant data protection authorities.

Otherwise, we securely erase your information once this is no longer needed.

​

Once the suitable storage period has passed, we will securely delete your information from our records.

Your data protection rights

Under data protection law, you have rights including:

Your right of access - You have the right to ask us for copies of your personal information.

Your right to rectification - You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.

  • Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.

  • Your right to restriction of processing - You have the right to ask us to restrict the processing of your personal information in certain circumstances.

  • Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.

  • Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.
     

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

What are the lawful bases for processing Data?

The lawful bases for processing are set out in Article 6 of the UK GDPR. At least one of these must apply whenever you process personal data:

The following reasons are basis for us storing your personal data:

(a) Consent: the individual has given clear consent for you to process their personal data for a specific purpose.

(b) Legitimate interests: the processing is necessary for your legitimate interests or the legitimate interests of a third party, unless there is a good reason to protect the individual’s personal data which overrides those legitimate interests.
